Acceptable use policy

This policy sets out what you may and may not do with podswitch. It forms part of our terms of service. The most important rule is simple: only upload recordings you have the right to upload, with permission from everyone whose voice is in them.

Permission from everyone recorded

Before you upload a recording, you must have permission from every person whose voice is in it for the recording to be processed by podswitch to edit it. In practice this usually means your guests have agreed to be recorded for your podcast or video, and know it will be edited.

You must not upload:

• recordings made secretly, or without the knowledge of the people recorded, where the law requires their knowledge or consent;
• recordings you do not have the right to use, for example because someone else owns the copyright and has not given you permission; or
• recordings that a person has asked you not to use, where they are entitled to make that request.

We act as your processor for the personal data in your recordings. You are responsible for having a lawful basis to record and process it, and for responding to anyone recorded who asks about their data.

Content you must not upload

You must not use podswitch to process content that:

• is unlawful, or promotes or facilitates unlawful activity;
• sexualises or exploits children in any way;
• harasses, threatens, defames or incites hatred or violence against any person or group;
• infringes anyone’s intellectual property, privacy or other rights; or
• contains malware or anything designed to damage or interfere with systems.

Using the service fairly

You must not:

• try to get around plan limits, the one-free-trial-per-email rule or other restrictions, for example by creating multiple accounts or using disposable email addresses to obtain more free trials;
• probe, scan or test the security of podswitch, or try to access accounts, projects or data that are not yours, unless we have agreed to it in writing;
• overload the service, or use automated means to access it except through features we provide for that purpose;
• copy, reverse engineer or resell podswitch, or offer it as part of another service, without our written agreement; or
• misrepresent who you are, or impersonate another person or organisation.

Reporting a problem

If you believe content processed by podswitch breaks this policy, or you have found a security issue, contact us at support@usepodswitch.com. For security reports, please give us reasonable time to fix the issue before disclosing it.

What happens if this policy is broken

We may remove content, suspend processing, or suspend or close the account involved, depending on how serious the breach is. Where it is reasonable, we will tell you first and give you a chance to put things right. Where the law requires it, we may report unlawful content to the relevant authorities.
